Loyal distributors and retailers represent Clos Pegase in every state, and we are strong supporters of the three-tier (winery-wholesaler-retailer) system, recognizing that the vast majority of our wines are sold in this way.

However, we also support the right of consumers to have legal access to any wine they choose by having that wine shipped to them -- especially when it would not otherwise be conveniently available.

Thirty-five years ago there were more than 5,000 alcoholic beverage wholesalers in the United States. Today, owing to widespread consolidation, there are fewer than 250. Even though this small number cannot conceivably handle all wineries -- especially smaller ones -- some wholesalers are determined to prevent others from selling in their territories. They have succeeded in having legislation passed in many states preventing us from shipping our wines directly to you.

The 21st Amendment to the United States Constitution gives states broad powers to regulate the sale of licensed beverages within their borders. But tested against Article I of the Constitution, which guarantees interstate commerce, the only clear power conferred upon the states by the 21st Amendment appears to be the power to go "dry" (no liquor sales) in whole or in part.

Interstate trade barriers are a serious threat to wineries and consumers alike. More than 20 states have already taken action to curtail the direct shipment of wine. But through grassroots efforts, we believe we can resist restricted consumer access to one of the earth's most wondrous products.

Shipping Policy

The following states allow us to ship our award winning wines to you. Please note that there may be quantity or county restrictions, depending on your state's laws.

Alaska, Arizona*, California, Colorado, Connecticut, Washington DC, Florida, Georgia, Hawaii, Idaho, Illinois, Indiana, Iowa, Kansas, Maryland, Massachusetts*, Michigan, Minnesota, Missouri, Nebraska, Nevada, New, Hampshire, New Jersey*, New Mexico, New York, North Carolina, North Dakota, Ohio, Oregon, South Carolina, Tennessee, Texas, Virginia, Vermont, Washington, Wisconsin, Wyoming.

*These states allow us to ship ONLY our Pegase Circle Selection wines to you. These states require 3-tier delivery. In order to comply with alcohol regulations in your state, your order will be transferred to a retailer in your state selected by our fulfillment agent. This also means higher shipping rates. We apologize for any inconvenience.

Shipping Time Frame

Due to individual state laws regarding wine shipping, travel time for orders vary. Most states can expect delivery within two weeks. If you require expedited shipping, please contact us or select the AIR service. For states only allowing shipments of Pegase Circle Selection Wines (those states marked above with an asterisk*), the time between ordering and receiving delivery can be substantial due to the requirement of a 3-tier delivery process. Packages are shipped out weekly, and you can expect delivery within 2-3 weeks from the shipment date. Terms & Conditions

Wine sold to you is sold in California and title passes to you, the buyer, in California. The buyer is solely responsible for shipment of wine. We make no representation concerning your legal rights to ship or receive wine into any state outside of California or into any country outside of the United States. In fact, there are certain counties, states and countries to which we cannot ship. By placing an order, you authorize us to act on your behalf to engage a common carrier to deliver your order to your selected destination.

You must be 21 years or older to buy wine. By placing your order you certify under penalty of perjury that you and the recipient are at least 21 years old. When the wine is delivered, the recipient will be required to show identification proving that he or she is at least 21 years old. The willful misrepresentation of your age or the age of the recipient is a crime in most states.

We ship Monday through Friday (holidays excluded). Sorry, delivery on weekends is generally not available. We cannot ship to PO Boxes or APO/FPO addresses. If no one is available to receive the package, two subsequent attempts to deliver will be made. Wine orders require an adult (age 21 or older) signature, so whenever possible, we strongly encourage you to use a commercial business address to assure the fastest delivery time. If your package is undeliverable and returned there will be a $14 return fee and/or your order may be subject to a 25% restocking fee.

Wine is a perishable product. We recommend avoiding shipment during extreme temperatures. Since you know your climate much better than we do, you are the best judge of the shipment method (ground or air shipping) and timing. The placement of your order verifies your agreement to this.
